Kevin M. Goldberg is legal counsel for ASNE and special counsel with Fletcher, Heald & Hildreth, PLC. His expertise is in First Amendment, copyright and trademark issues, especially those relating to newspaper and Internet publishing. He regularly advocates issues involving freedom of speech on behalf of press organizations. Kevin also consults regularly with these organizations concerning the continued freedom of speech on the Internet, focusing on issues such as regulation and voluntary implementation of blocking software. Kevin assists newspapers and television and radio stations in prepublication review of stories for possible legal problems.

Kevin also assists the firm’s broadcast clients on a wide variety of intellectual property matters. In addition to filing applications for federal and state copyright and trademark registrations, he advises clients on the steps which can be taken to avoid copyright and trademark infringement liability.  Specific to broadcast stations, this includes compliance with the statutory license applicable to webcasting, as well as undertaking negotiations with the major performing rights organizations which license use of musical works.  Kevin has also successfully litigated, as a plaintiff and defendant, claims arising out of the Anti-Cybersquatting Consumer Protection Act and the Internet Corporation for Assigned Names and Numbering’s Uniform Domain Name Dispute Resolution Policy.

Kevin's interest in the First Amendment stems from an undergraduate major in communications, with a focus on TV/Radio and Journalism, at James Madison University, an institution from which he graduated Magna Cum Laude in 1992.

After graduation from James Madison, Kevin attended law school at George Washington University. He was graduated with high honors in 1995.

Kevin is currently licensed to practice in Virginia, Maryland, and the District of Columbia. He is also an adjunct professor at George Mason University, where he teaches Journalism Law in the Communications Department. He is a member of the First Amendment Advisory Council of the nonprofit organization The Media Institute. He also serves as the Chair of the Legislative Affairs Committee of the Media Law Resource Center. On March 16, 2006, he was inducted into the National Freedom of Information Hall of Fame for his continued and superlative service in pursuit of open government. He is the youngest of the current 56 members in the Hall. He has written several articles on issues of importance to the media, is a regular speaker at local and national conferences and has appeared on major media such as MSNBC, NPR and Fox Television as a legal expert on content related issues.
